Lawyers for repatriated Indian businessman, Ashok Kumar Sivaram have petitioned Ghanaian authorities for a possible re-entry of their client into the country.
In a letter forwarded to the Interior Minister by his Attorney and sighted by this website bemoaned that the Jai Mai Communications Limited, a local based Company of the Indian businessman would be injuriously affected in terms of its operations and the welfare of over one hundred and Sixty workers employed by the Telecom Company, following his repatriation.
“The Company pays taxes to the Government of Ghana. Thus it is imperative that the paramount interest of the Company and the workers be taken into consideration so as to re-issue Mr. Sivaram’s Residence/Work permit,” the letter dated 14th March read in part.

Background
The Supreme Court on March, 8, 2018 set aside an order by an Accra High court in the restoration of the residence and work permit of embattled Indian businessman, Ashok Kumar Sivaram.
According to the Justices of the Supreme court, the High Court Judge who sat on the case erred in granting the order of mandamus. The court also indicated that the High court Judge exceeded her jurisdiction in making the order. The Justices also added that mandamus could not be granted in the situation when the businessman has not gone through the administrative process of getting the revocation addressed.
The Comptroller of the Ghana Immigration Service appealed to the High Court ruling after it ordered him to restore the Indian businessman residence and work permit.
The Indian arrived on 2nd August, 2017 only for him to be detained by the immigration because he didn’t have a visa. He was subsequently deported on grounds that he’d forged his marriage certificate, an application for citizenship.
The high court on 31st July, 2017 declared the deportation of the Indian as illegal and an abuse of discretionary power on the part the the Interior Minister, Ambrose Dery.
