The Member of Parliament for Ashaiman, Ernest Norgbey, has sued the government for some procurement breaches in the $12.5 million drone agreement to Fly Zipline Ghana Limited.

Mr. Norgbey in his writ, has indicated per the Public Procurement Act, government failed to satisfy the laws under such condition before going ahead to engage Fly Zipline in the single source procurement of the $12.5 million medical deliveries contract.

“If you want to just engage in single source procurement method, you’ll have some procedures to follow and you’ll have to make sure that you satisfy those conditions before you enter into the single source procurement. These conditions that are stated in the Act must be satisfied…So you’ll realised that Section 40(2) of the PPA has been breached,” he told host Kwaku Owusu Adjei on Anopa Kasapa on Kasapa 102.5 FM.

According to him, if the government had made it public, other interested parties like DHL, Swoop Aero and others could have popped up to compel the government to settle on restricted tendering rather than the single source procurement.

The MP in his writ is therefore seeking a declaration that “the Government of Ghana erred in using single sourcing method of procurement in engaging Fly Zipline Ghana Ltd for the implementation of Zipline RPAS for the delivery of blood products.”

He also wants a declaration that the service agreement was “illegal and therefore void” and an order “invalidating the service agreement.”
