Ex-President John Mahama at the Supreme-Court

The Supreme Court will later today, Monday, February 15, 2021, hear an application by lawyers of John Dramani Mahama to reopen his case in the 2020 election petition case.

This comes on the heels of the Supreme court ruling last week, February, 13, 2021 that the Chairperson of the Electoral Commission, Jean Mensa and Peter Mac Manu cannot be compelled to step into the witness box to testify in the election petition case.

Following this, John Mahama filed a fresh application to reopen his case which will be heard by the apex court today.

The petitioner intends to subpoena Jean Mensa to testify, despite the first respondent’s unwillingness to do so.

But, the Electoral Commission through its chairperson Jean Mensah has filed an affidavit in opposition to this request.

“At no time have I informed the petitioner or his lawyers of my desire to testify in this case”, the affidavit states.

She said should the court even grant the request for the case to be reopened, it should not order her to testify since such a decision will defeat its earlier ruling that she cannot be compelled to testify.
