Some separated staff from the various units under the Ministry of Justice and Attorney-General are still on Ministry’s payroll and receiving monthly salary, a 2014 report by the Auditor-General has revealed.

During the period under review, an unspecified number of separated staff, according to the report, received unearned salary totalling GH₵190,317.62.

For instance, at the Accra office of the Judicial Service, various staff were paid unearned salary totally GH₵176,928.10 covering a period of 12 months.

The causes of the anomalies, the reported noted, included delays by Heads of management Unit in promptly notifying serving banks of separated staff to freeze and ensure the transfer of the unearned salaries into the Consolidated Fund.

Regulations 297 and 298 of the Financial Administration Regulation (FAR), 2004 which require that a Head of Department shall cause the stoppage of payment of salary to a public servant when that public servant has retired, vacated post, resigned or died, failure of which, amounts to breach of financial discipline.

The Auditor-General worried about this anomaly has recommended for full recovery of the total unearned salaries of GH₵190,317.62.

The report also recommended to all the Heads of Management Units of the Ministry of Justice and Attorney General to take advantage of the introduction of the ESPV by the Controller and Accountant General Department to minimize the occurrence of unearned salaries.
