A Single Court of Appeal Judge, Justice Henry Kwofie has fixed July 26 to rule on Human Right Lawyer, Francis Xavier Sosu’s application for stay of execution of his 3-year ban handed him by the General Legal Council.
This was after parties in the case had made their respective oral submissions to the court.
Lawyer Sosu has been slapped with a three year suspension by the GLC for overestimation of legal fees in a case that involved one Francis Agyare, when he represented him in a Human Right matter in Accra.
In court today, lawyers for the General Legal Council vehemently opposed to the the application for stay of execution pending appeal of suspension.
According to them, the applicant did not file any notice of appeal at the registry of the GLC and that means there was no notice of valid appeal for stay of execution.
He therefore stated that the court lacked jurisdiction to hear the matter since the notice was wrongly filed and however prayed for the application to be dismissed.
Lawyer Samuel Cudjoe for the applicant had argued that the GLC had no registry and therefore filed their notice of appeal at the high court.
While admitting that the process was wrongly filed, he contended that the GLC is not a court hence the decision to file the appeal at the high court.
Though he admitted that the records of appeal has not be compiled at the registry at the Court of appeal, he asked the court to exercise its jurisdiction to grant their application.
