The Supreme Court has scheduled today, January, 28, 2021 to begin hearing the substance of the ongoing 2020 election petition case brought before the apex court by National Democratic Congress’ flagbearer, John Mahama.
The court was originally billed to hear the substantive case on January 26 however, the petitioner failed to file his witness statements as ordered by the court.
Lawyers for Mr. Mahama only complied with the Supreme court’s order on Wednesday, January 27, 2021 after the petitioner’s evasive action in the past days.
The petitioner who’d earlier told the court that they had five witnesses, managed to file witness statements of two instead of the initial five he indicated to the court. The General Secretary of the National Democratic Congress (NDC), Mr. Johnson Asiedu Nketia and Michael Kpessa-Whyte, a former Executive Director of the National Service Secretariat, were filed as witnesses.
This has paved the way for the court to move to the substantive matter today, amid a review motion.
Meanwhile, US-based Ghanaian lawyer, Professor Kwaku Asare, aka Kwaku Azar, has predicted that the election petition trial is likely to start in February instead of today, January 28, 2021.
“It is unlikely that the trial will commence on 1/28, in light of the pendency of the review action and the Court’s order today,” Kwaku Azar said in a Facebook post after sitting on Tuesday.
